Our Constitution has been framed in such a manner that the Judiciary has been kept independent of the Executive and the Legislature. This has been done
- To keep a check on the misuse of powers by the other two organs of the government.
- To provide a judgement which is impartial.
Thus, the courts do not fall under the government and do not act on their behalf.
It is this independence of the judiciary that allows the courts to play a central role in protecting the Fundamental Rights of all the citizens. Thus, anyone can approach the courts if they believe that their rights have been violated.
