When does a seat become vacant in either house of the Parliament?

A seat can become vacant in either house of Parliament in the following situations:

  1. If a member resigns from the House or vacates his/her seat simply by writing to the Speaker or the Chairman indicating about him vacating the seat.
  2. If a member is absent from the House without permission for a period of 60 days.
  3. If a member is disqualified on the grounds of defection according to norms laid down under the Anti-Defection Law.
  4. If a member is subjected to any of the disqualifications laid down by the Constitution or an Act of Parliament.
  5. If a person is a member of the State Legislature and is elected to the Parliament.
