When can an Ordinance be issued by the President?

The President can issue an ordinance in the following situations:

  1. When he is satisfied that the circumstances are necessary for him to take immediate action.

  2. It can be promulgated when both the Houses are not in session. However, even if one is in session, there is no bar in issuing an ordinance.

  3. The ordinance has to be laid down before both the houses when they reassemble. If the Parliament does not approve the Ordinance lapses.
