When can a member be disqualified from being a member of the Rajya Sabha.

A person can be disqualified from being or chosen to be a member of the Rajya Sabha

  1. If he/she holds an office of profit under the government of India or under the government of any state (other than an office exempted by Parliament by law) but not a minister for Union or for a state.
  2. If he/she is of unsound mind and is declared so by a competent court.
  3. He/she is an undischarged insolvent.
  4. He/she has ceased to be a citizen of India or has voluntarily acquired citizenship of a foreign country/state or is under acknowledgement of allegiance or adherence to a foreign power.
  5. He/she is disqualified by or under any law made by the Parliament.
