Explain any three reasons behind the inclusion of the Fundamental Rights in Part III of the Constitution.

The following are three reasons why Fundamental Rights have been included in Part III of the Constitution:

  1. The Fundamental Rights guaranteed by the Constitution are in the nature of social and political rights, corresponding to the International Covenant on Civil and Political Rights (ICCPR), 1996.
  2. Fundamental Rights are bestowed on every citizen of India without consideration of their caste, colour, creed, sex or religion.
  3. Fundamental Rights are justiciable. This means that a suit can be filed in a High Court or the Supreme Court if they are violated. The Court has the power to take steps through various Writs to determine the legality of such an action by the legislature or any concerned government officer. It can strike down a legislation that encroaches upon any of the Fundamental Rights of the citizens.
