The effects of the proclamation of National Emergency on the Fundamental Rights of Indian Citizens are as follows:

  1. In the event of a proclamation of National Emergency, Fundamental Rights guaranteed under Article 19 of the Constitution, i.e., Right to Freedom of speech and assembly, remain suspended.

  2. The President can suspend the right to move court for the enforcement of such rights as may be mentioned in the order, except the rights enumerated in Articles 20 and 21. The former stipulates that a person cannot be punished for the same offence more than once. The latter says that ‘’no person shall be deprived of his life or personal liberty except according to procedure established by law.”
