Why can't we apply formula (Max Power= E²/4r) here?

Maximum power drawn from battery is when the terminals of battery are short circuited
so that all the current is dissipated across internal resistance.
Maximum current = E / r
Where E is EMF of battery and r is internal resistance of battery
Maximum power = Voltage × Current = E × (E/r) = E2 / r = ( 12 × 12 ) /0.4 = 360 W
