  • John Milton, the English poet once said," Give me the liberty to know, to utter, and to argue freely according to conscience, above all liberties”.
  • The Supreme Court recently passed a judgment, "'Right to privacy' is an integral part of Right to Life and Personal Liberty guaranteed in Article 21 of the Constitution. Right to privacy is intrinsic to the entire fundamental rights."
  • If right to privacy is constitutional, the freedom of speech and expression occupies the utmost position in the hierarchy of liberty. 
  • A human being acquires the essence of free speech and expression right from the time he is born.
  • Article 19(1)(a) reflects to secure every person's liberty of thought and expression.
  • Opinions and one's convictions can be expressed through any visible communicable medium such as pictures, printing, writing and words of mouth.
  • Freedom of speech is guaranteed not only by the constitution or statutes of various states but also by various international conventions like Universal Declaration of Human Rights, European convention on Human Rights and many more.
  • The right to speak and express boards a special purposes too:
  1. To attain self fulfillment
  2. Discovery of truth by open discussion
  3. Decision-making
  4. For active participation in parliamentary democracy
  5. Establish a reasonable balance between stability and social change 
  • Democracy is most important feature of today’s world. Freedom of speech, the most basic element protects the right of all citizens and extends the concept of basic existence to understand political and social issues so that they can be a part of the smooth working of democracy.
  • It is not only the right of an individual but rather a right of the community to hear and be informed.
  • Liberty to express opinions and ideas, without hindrance and
  • especially without fear of punishment, plays significant role in the development of that particular society and ultimately for that state.
  • The Preamble expresses two ideas:
  1. Rights of the individual which correspond to the duties of the State towards the individual
  2. Duties of the individual towards the State which correspond to the rights of the society against the individual
  • Freedom of speech and expression should, therefore, receive generous support from all those who believe in the participation of people in the administration.
